Idaho State Capitol – On Wednesday, House Commerce and Human Resources printed legislation sponsored by Representative Jake Ellis/(D-Boise). The purpose of the legislation is to ensure that architects and engineers who are asked to volunteer during an emergency are able to do so with limited liability. Rep. Ellis has been working closely with the American Institute of Architects – Idaho Chapter on the legislation.
“Idaho architects and engineers are sometimes asked to lend their expertise during an emergency.” Rep. Ellis explained “Their skills can give important insight that helps first responders make safer decisions. However, architects and engineers are not protected from liability the same way that our first responders are.”
The legislation does make it clear that architects and engineers have limited liability if any injury, death, or damage is a result of unreasonable acts, gross negligence, or misconduct.
“The legislation isn’t complete immunity from being held accountable.” Rep. Ellis explained. “We just want to make sure that everyone working on a declared emergency is given the same limited liability protection.”
